SPAM-JAMR™ — Advanced Call Protection

1. Acceptance of These Terms

These Terms of Service ("Terms") are an agreement between you and CYBERINE LLC ("we," "us," "our") governing your use of the SPAM-JAMR™ Android application (the "App"). By installing or using the App, you accept these Terms. If you do not agree, do not install or use the App.

2. License

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on Android devices you own or control, for personal call screening use. This license does not permit you to:

Sell, rent, lease, sublicense, or redistribute the App
Reverse engineer, decompile, or disassemble the App except where such restriction is prohibited by applicable law
Remove or alter any trademark, copyright, or proprietary notices
Use the App or its data outputs to build a competing product or dataset

Your use of the App is also subject to the Google Play Terms of Service under which the App is distributed.

3. Acceptable Use

You agree to use the App only for lawful, personal call screening, and not to:

Attempt to bypass, disable, or defeat the App's protections or security measures
Use the App to harass any person or to interfere with lawful communications
Misrepresent the App's risk assessments as authoritative determinations of any caller's identity or intent

If you discover a bug or security issue, please report it responsibly via cyberine.us.

4. How the App Works — Important Limitations

No blocking guarantee. SPAM-JAMR uses risk analysis based on area code intelligence, on-device machine learning, behavioral patterns, and public regulatory data. Risk scoring is probabilistic. The App may fail to block unwanted calls and may assign elevated risk to legitimate calls. You remain in control of, and responsible for, all blocking decisions and settings.

Emergency services: The App screens incoming calls only. It does not interfere with your ability to place outgoing calls, including calls to emergency services. Do not rely on the App in any way that could affect emergency communication.
Third-party data accuracy: Risk data derived from FTC, FCC, carrier STIR/SHAKEN verification, and other sources is provided by those parties and is not warranted by us to be accurate, complete, or current.
Permission and role dependence: Protection operates only while SPAM-JAMR remains your selected Caller ID & spam app and its Android permissions remain granted. If you reassign that role or revoke a permission (including "Appear on top" / "Display over other apps"), screening or the call overlay will stop or be reduced. The App alerts you when protection capability is lost and shows you how to restore it, but Android does not permit any app to restore its own roles or permissions — restoration always requires your action in system settings.
Other screening layers: Your carrier and your device manufacturer may operate their own spam filtering and caller ID features (for example, built-in dialer spam protection) independently of the App. Those layers may label, allow, or block calls without the App's involvement or knowledge, and the App's statistics and call records do not reflect their decisions.
Carrier and device dependence: Call screening depends on Android system features, your device, and your carrier. Functionality may vary or be unavailable on some configurations.

5. Privacy

The App processes calls on-device and transmits no personal information. Our privacy practices are described in the SPAM-JAMR Privacy Policy, which is incorporated into these Terms.

6. Intellectual Property

The App's original software, design, and content are owned by CYBERINE LLC and protected by copyright and other intellectual property laws. The App also incorporates third-party open-source components, which remain the property of their respective owners and are used under their own licenses; credits are listed under Legal Acknowledgments in the App. SPAM-JAMR™ is a trademark of CYBERINE LLC. Government data used by the App (including FTC and FCC complaint data) is public domain as a work of the United States Government; our compilation, scoring, and presentation of that data are our own work.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BLOCK ANY PARTICULAR CALL, THAT RISK ASSESSMENTS WILL BE ACCURATE, OR THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYBERINE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM CALLS THAT WERE OR WERE NOT BLOCKED, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP, IF ANY. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

9. Updates and Termination

We may update, modify, or discontinue the App or any feature at any time. We may terminate this license if you violate these Terms. You may terminate at any time by uninstalling the App, which also deletes all App data from your device.

10. Changes to These Terms

We may revise these Terms by publishing an updated version at this address with a new effective date. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of West Virginia, USA, without regard to conflict-of-law principles. Any dispute shall be brought in the state or federal courts located in West Virginia, and you consent to their jurisdiction.
